The Contract

The first major step

Once you have found a home you want to buy or a buyer for the home you want to sell, the next major step is the contract. The document is of extreme importance. It was obligate you legally and will set forth all of the major terms of the transaction. It is imperative that you understand the contract and that you are in full agreement with all of the terms and everything is in your best interest. That is where we come in.

We are available to review the contract PRIOR to signing

The realtor can explain the entire contract and is the one that fills it out. But the realtor's ability to explain it from a legal standpoint is limited. We not only encourage you to consult with us on the contract, but to do it prior to signing. We do not charge for this and feel that it is pure professional courtesy to review the contract. If you go ahead and sign it without consulting us, then we still encourage you to call as we can explain what the process will be and we can let you know of any special conditions or considerations that you need to be aware of.

Specific terms you need to understand-----the price, time frames & conditions

Much of the standard real estate contract with have basic terms they most of them share. There are some terms that your realtor will fill out that will be specific to your transaction. Such as the closing date, the price, the extension time (this is a number of days in which the parties agree to extend the contract in the event that they cannot close on or before the closing date for some reason), and so forth. Occasionally it will have special terms or conditions that the parties for one reason or another agreed to on the particular sale.

Financing

The contract will usually have a place where financing information will need to be put in, which will state what sort of financing the buyer will be obligated to obtain and what happens in the event that the buyer cannot get that financing.

Costs of the closing and special obligations

Sometimes the contract will state who is paying for certain costs of the closing, and  could have special language about termite inspections, home warranties, title insurance, and other matters that for one reason or another the parties felt should be part of the agreement.

The importance and the legal affect of the contract being correct & accurate

The contract is the single most important document that both the buyer and seller will sign together. It needs to be legally sound and it needs to properly reflect each party's intent, goals, needs and preferences.
