Laws & Process

This section of the web site is devoted to how the criminal process works and provides explanations of the different courts, peoples’ Constitutional Rights, various Defenses, Sentencing, how Plea Agreements work, the various stages in the process, what to expect when you go to court, and so on.

Unless you have been through the criminal process, it can be extremely confusing and down-right overwhelming. You are encouraged to look through the different sections and read the material as it might apply to your specific legal situation. Anything that might not be clear or that you might have more questions on, you are more than welcome to call or email and we’ll be more than happy to explain.

Some aspects to the process are the same for all defendants, such as Constitutional Rights, Bond Hearings and the Trial process. Other things will vary from case to case such as Sentences, Motions, Defenses, and so forth.

With this section you can look up any major aspect and see if it applies to your charge(s), and how it affects you and your case. You can see the difference between Misdemeanors and Felonies and see how the misdemeanors are handled in Magistrate or Municipal Courts and how the Felonies are in General Sessions. Or how the judge bases the amount of a person’s bond, or what Discovery is, what rights you have at trial such as cross examination and remaining silent and not testifying, or about Roster Meetings, Roll Calls, Preliminary Hearings, and so on.

Please keep in mind that most people’s cases are handled on a case by case basis. That is why this web site and this section are so important. There is invaluable information in this section. Keep in mind that one of the most dangerous things a person can do is to take legal advise from a non-lawyer, and that includes taking the advise of police officers. What applies to one person’s case, may be entirely different with another person’s case, even though the charge(s) are identical.

Please feel free to call with any questions or concerns. We never charge for talking. Consultations are always free and we would be more than happy to discuss your situation and provide you with a Case Evaluation.

I encourage people to contact me at my personal email address and I will respond the same day.
